My Tern Eclipse P9 pedal has snapped off

I've recently purchased a Tern Eclipse P9 (approx 4 weeks ago) and was initialy impressed with the bike, it is quick to fold and get on the train and enables me to commute quickly across London. That is until last night when pulling away from the traffic lights in central London resulting in the right pedal snapping off and nearly putting me under the nearest taxi, needless to say I am not impressed as the bike has only done approximately 40 miles and was serviced 2 days before. The bike was quickly returned to LBS who swapped the pedals for none folding variants as they thought the issue was associated with the metal impacting with the plastic resulting in the plastic snapping (these are being returned to tern). Has anyone else experienced this problem? and are there any other issues I should be concerned about?
